VIP Golf Schools Terms of Use

Welcome to Woodstone VIP Golf School Featuring Eric Cogorno (the “Golf School”), operated by Cogorno Golf Inc. in collaboration with Woodstone Country Club. By accessing, registering for, or participating in the Golf School, you ("Participant") agree to the following Terms of Use. If you do not agree with these terms, you should not participate in or use any services provided by the Golf School.

1. AGREEMENT TO TERMS

By registering for and attending the Golf School, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Use, along with any additional guidelines or rules provided by Cogorno Golf Inc. or Woodstone Country Club.

2. INTELLECTUAL PROPERTY RIGHTS

The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, and all Intellectual Property Rights related thereto, are the exclusive property of Cogorno Golf Inc. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works from any materials or content accessible on the Service.

Copyright & Trademark Restrictions on Use:

  • All content on our website and instructional materials, including text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Cogorno Golf Inc. or its content suppliers and is protected by United States and international copyright laws. The compilation of all content on this site is the exclusive property of Cogorno Golf Inc. and is protected by U.S. and international copyright laws. All software used on this site is the property of Cogorno Golf Inc. or its software suppliers and is protected by U.S. and international copyright laws.

3. PROHIBITED ACTIVITIES

You may not access or use the Service for any purpose other than that for which we make the Service available. The Service may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us. Systematic retrieval of data or other content from the Service to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us is prohibited. Participants agree not to:

  • Disrupt or interfere with any coaching sessions, instructors, or fellow participants.
  • Attempt to record, reproduce, or distribute proprietary Golf School content.
  • Use Golf School services for any unlawful or unauthorized purpose.
  • Engage in behavior that is disruptive, disrespectful, or unsafe to other attendees or staff.

Failure to comply may result in immediate dismissal from the Golf School without a refund.

4. PROGRAM OVERVIEW & PARTICIPANT RESPONSIBILITIES

  • The Golf School provides in-person coaching, on-course strategy training, swing analysis, and mental performance coaching.
  • Participants must be at least 18 years old or have written parental/guardian consent.
  • Participants agree to follow all safety instructions from instructors and facility staff.

Participants are responsible for their own transportation and accommodations, unless otherwise specified.

5. PAYMENTS, CANCELLATIONS & REFUNDS

  • Full payment is required upon registration to secure a spot. We accept major credit cards, personal checks, and electronic bank transfers.
  • Due to limited availability, all sales are final and non-refundable. However, credits may be issued at the discretion of the Golf School.

If the Golf School is canceled or rescheduled due to weather, facility issues, or other unforeseen circumstances, participants may choose to reschedule or receive a credit toward a future event. We are not responsible for any travel expenses incurred due to cancellations. We strongly recommend purchasing travel insurance to protect against unforeseen circumstances.

6. ACCOMMODATIONS AND FACILITIES

  1. Lodging: Reservations at The Lodge at Woodstone are subject to availability and their specific terms and conditions.
  2. Facility Use: Participants must adhere to all Woodstone Country Club rules and regulations during their stay.
  3. Damages: Participants are financially responsible for any damages caused to facilities, equipment, or property.

7. INSTRUCTION AND CURRICULUM

  1. Instruction: While Eric Cogorno is the featured instructor, some sessions may be conducted by other qualified Cogorno Golf Inc. professionals.
  2. Skill Level: We reserve the right to reassign participants to appropriate skill level groups to ensure optimal learning.

8. HEALTH AND SAFETY

  1. Physical Requirements: Golf Schools involve physical activity. Participants are responsible for ensuring they are physically capable of participation.
  2. Medical Conditions: Participants must disclose any medical conditions that might affect their participation.
  3. Injuries: Cogorno Golf Inc. and Woodstone Country Club are not liable for injuries sustained during participation in Golf School activities.

9. MEDIA RELEASE

  1. By participating in our Golf Schools, you grant Cogorno Golf Inc. permission to use photographs, video, and testimonials featuring your likeness and comments for promotional purposes without compensation.
  2. If you do not wish to be photographed or recorded, please notify our staff in writing prior to the start of your Golf School session.

10. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Cogorno Golf Inc., Woodstone Country Club, instructors, staff, and affiliates shall not be liable for:

  • Any personal injury, property damage, loss of valuables, or other incidents that occur during participation.
  • Any business losses, revenue loss, or consequential damages related to the Golf School experience.

Participants assume all risks associated with attending and participating in the Golf School.

11. INDEMNIFICATION

  • You agree to indemnify, defend, and hold harmless Cogorno Golf Inc., its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Terms of Use or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing our services using your account.

12. SITE MANAGEMENT & SECURITY

  • We reserve the right, but not the obligation, to: (1) monitor the Service for violations of these Terms of Use; (2) take appropriate legal action against anyone who, in our sole discretion, violates the law or these Terms of Use, including without limitation, reporting such user to law enforcement authorities; (3) in our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your Contributions or any portion thereof; (4) in our sole discretion and without limitation, notice, or liability, to remove from the Service or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems; and (5) otherwise manage the Service in a manner designed to protect our rights and property and to facilitate the proper functioning of the Service.
  • We implement reasonable security measures to protect your personal information. However, no data transmission over the internet or electronic storage system can be guaranteed to be 100% secure. We cannot ensure or warrant the security of any information you transmit to us, and you do so at your own risk.

13. MOBILE TERMS & CONDITIONS

Cogorno Golf offers its customers mobile alerts regarding billing status, product launches, and cart reminders by SMS message (the "Service"). By purchasing a product or service from Cogorno Golf Inc., you agree to receive mobile alerts via SMS related to:

  • Billing status, product launches, and cart reminders.
  • Promotional offers and event updates.

You may opt out of receiving these communications at any time by texting "STOP" to the short code provided or by contacting us directly.

14. GENERAL TERMS OF USE

  • Modification of Terms of Use: Cogorno Golf Inc. reserves the right to modify these Terms of Use at any time without prior notice. Changes will be effective immediately upon posting on our website. Your continued use of our services after any changes indicates your acceptance of the modified terms.
  • No Responsibility/Liability for Linked Third Party Websites: Our website may contain links to third-party websites. These links are provided for your convenience only. Cogorno Golf Inc. has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party websites.
  • Hyper-Links: You may not create hyperlinks to our website without our express written permission. Any permitted links must be lawful and cannot suggest any endorsement by or affiliation with Cogorno Golf Inc.
  • Accuracy of Information Provided by Users: You are responsible for ensuring that all information you provide to us is accurate, complete, and current. Providing false or misleading information may result in immediate termination of your participation in our Golf Schools.
  • Binding Contract, Jurisdiction and Venue: These Terms constitute a binding contract between you and Cogorno Golf Inc. Any disputes arising out of these Terms shall be governed by the laws of the Commonwealth of Pennsylvania. You agree that any legal proceedings shall take place exclusively in the courts located in Lehigh County, Pennsylvania.

15. DISPUTE RESOLUTION

  • Informal Resolution: Participants agree to first attempt to resolve disputes by contacting Cogorno Golf Inc. directly.
  • Binding Arbitration: If a resolution cannot be reached, disputes shall be settled through binding arbitration in Lehigh County, Pennsylvania.
  • Class Action Waiver: Participants agree that disputes must be handled individually and not as part of a class-action lawsuit.

16. DISCLAIMER

THE SERVICE IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SERVICE WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICE AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICE'S CONTENT OR THE CONTENT OF ANY WEBSITES LINKED TO THE SERVICE AND WE WILL ASSUME NO LIABILITY OR RESPONSIBILITY FOR ANY (1) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT AND MATERIALS, (2) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE SERVICE, (3) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN.
